Please read these Terms of Service ("Terms") carefully before using Fitness Monkey ("the App," "Service," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using Fitness Monkey, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Fitness Monkey.

2. Description of Service

Fitness Monkey is a personal wellness application designed to help users track their sobriety journey alongside their fitness goals. The App provides tools including:

  • Sobriety tracking and milestone celebrations
  • Workout logging and fitness tracking
  • Personal journaling
  • Recovery meeting check-ins
  • Trigger identification and management
  • AI-powered insights and recommendations

3. Eligibility

You must be at least 13 years of age to use Fitness Monkey. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

Account Creation. To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Account Deletion. You may delete your account at any time through the App settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

5. Health and Medical Disclaimer

NOT MEDICAL ADVICE. Fitness Monkey is a wellness tool and is NOT a substitute for professional medical advice, diagnosis, or treatment. The App does not provide medical advice, mental health treatment, or addiction treatment services.

Consult Professionals. Always seek the advice of your physician, mental health professional, addiction counselor, or other qualified health provider with any questions you may have regarding a medical condition, mental health concern, or substance use disorder. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked in this App.

Emergency Situations. If you are experiencing a medical emergency, mental health crisis, or are in danger of harming yourself or others, please contact emergency services immediately by calling 911 (in the US) or your local emergency number. You can also contact:

No Guarantees. We make no guarantees regarding sobriety outcomes, recovery success, or fitness results. Individual results vary, and your progress depends on many factors outside the App's control.

6. User Content

Your Content. You retain ownership of any content you create within the App, including journal entries, workout logs, and personal notes ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.

Content Responsibility. You are solely responsible for your User Content. We do not endorse, guarantee, or assume responsibility for any User Content.

AI Features. If you use our AI-powered features, your User Content may be processed by third-party AI service providers (such as OpenAI) to generate personalized insights. This processing is conducted in accordance with our Privacy Policy.

7. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App, other users' accounts, or our systems
  • Interfere with or disrupt the App or servers connected to the App
  • Upload or transmit viruses, malware, or other malicious code
  • Use the App to harass, abuse, or harm another person
  • Impersonate any person or entity
  • Collect or harvest any information from the App or other users
  • Use automated means (bots, scrapers) to access the App
  • Reverse engineer, decompile, or disassemble any aspect of the App
  • Circumvent any security measures or access controls

8. Intellectual Property

The App and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of Fitness Monkey. The App is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

9. Third-Party Services

The App may contain links to or integrate with third-party services, including AI providers. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE SPECIFICALLY DISCLAIM ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR EFFECTIVENESS OF ANY HEALTH, FITNESS, OR RECOVERY INFORMATION PROVIDED THROUGH THE APP.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FITNESS MONKEY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the App
  • Any conduct or content of any third party on the App
  • Any content obtained from the App
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any decisions or actions taken based on information provided by the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.

12. Indemnification

You agree to defend, indemnify, and hold harmless Fitness Monkey and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. You may also terminate your account at any time by deleting it through the App settings.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice through the App or by other means. Your continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Marin County, California.
